Delta: Omo-Agege insists court ‘clearly misapprehended electoral jurisprudence,’ heads to Supreme Court
Candidate of the All Progressives Congress (APC) in the March 18 governorship election in Delta State, Senator Ovie Omo-Agege has announced his decision to challenge the Court of Appeal ruling which dismissed his case Friday, and affirmed the election of Sheriff Oborevwori of the Peoples Democratic Party (PDP) as governor of Delta State.
Senator Omo-Agege had challenged the victory of Governor Oborevwori at both the Delta Governorship election Petitions Tribunal, however, at the Court of Appeal in Lagos, the latter dismissed his suit, Friday, for lacking in merit.
The judgment was delivered nearly two months after the Delta State Governorship Election Petition Tribunal had upheld Oborevwori’s election.
The three-member tribunal headed by Justice C.H. Ahuchaogu dismissed the petition filed by former Deputy President of the Senate, Ovie Omo-Agege of the APC
The tribunal held that the petition contained unsubstantiated allegations, noting that it was devoid of merit and speculative.
However, reacting immediately after the judgement, Senator Omo-Agege, who is also the immediate past Deputy President of the Senate said he was heading to challenge the appellant court ruling at the apex court.
Omo-Agege who noted that he has much respects for their Lordships at the Appeal Court in spite of their Friday verdict, said he remains ‘convinced that the learned justices clearly misapprehended the reformed electoral jurisprudence that now prevails to deepen democracy in the country.’
In a statement issued after the decision and signed by his Media Adviser, Mr. Sunny Areh, the former deputy senate president said he firmly believed that justice was yet to be served the people of Delta State whom, he claimed, voted for him and the APC.
“We will proceed to the Supreme Court. The issues at stake touch on the future and wellbeing of the people who voted for a New Delta.
“We have a duty to respect them by defending their faith in us with every sense of diligence and responsibility. We don’t waver on what is right.
“I am confident that the revered Justices of the Supreme Court will examine the areas overlooked at the Appeal Court and give justice to our people.
“I have absolute confidence in will, at the final hurdle, serve justice and redemption now deferred,” he said.
